RSBI Dibubarkan Mahkamah Konstitusi

Mahkamah Konstitusi (MK) Akhirnya membatalkan Pasal 50 ayat 3 UU Nomor 20 Tahun 2003 tentang Pendidikan Nasional yang menjadi dasar pembentukan Rintisan Sekolah Bertaraf Internasional (RSBI) dan Sekolah Bertaraf Internasional (SBI). Dengan demikian keberadaan RSBI dan SBI dihapuskan dalam penyelenggaraan sistem pendidikan di Indonesia.

“Permohonan beralasan menurut hukum. Mengabulkan permohonan pemohon seluruhnya, bahwa pasal 50 ayat 3 bertentangan dengan UUD 1945”, ujar Ketua MK, Mahfud MD saat membacakan putusan perkara judicial review itu di gedung MK, Jakarta, selasa (08/01/2013).

Dalam hal ini MK tidak menafikan pentingnya Bahasa Inggris, tapi istilah internasional sangat berpotensi mengikis kebudayaan dan Bahasa Indonesia. MK juga menilai output pendidikan yang dihasilkan RSBI dan SBI adalah siswa berprestasi, namun tidak harus berlabel berstandar internasional.

“Selain terkait dengan masalah pembangunan jati diri bangsa, RSBI dan SBI membuka peluang perbedaan antara sekolah RSBI/SBI dengan sekolah non RSBI/SBI”, demikian bunyi putusan MK. Lebih lanjut MK juga mengatakan bahwa pemerintah harus memberi perlakuan khusus bagi mereka yang kemampuan khusus. Namun pemberian pelayanan berbeda tidak dapat dilakukan dalam bentuk sekolah RSBI/SBI dan non RSBI/SBI. Karena hal ini menunjukkan ada perlakuan berbeda dari pemerintah.

“Baik fasilitas, pembiayaan, sarana prasarana, RSBI/SBI dapat fasilitas lebih. Implikasi pembedaan demikian mengakibatkan RSBI/SBI saja yang menikmati fasilitas memadai. Sedangkan sekolah non RSBI/SBI fasilitasnya sangat terbatas”, demikian MK.

Fakta lainnya, bahwa siswa di sekolah RSBI harus membayar biaya lebih banyak. Hanya masyarakat mampu yang kebanyakan bersekolah di RSBI. Walau ada beasiswa kurang mampu, tetapi hal itu sangat kecil dan hanya ditujukan bagi anak-anak sangat cerdas, sedangkan anak tidak mampu secara ekonomi, kurang cerdas, tidak mungkin bersekolah di RSBI.
